Custom Design Projects — Terms & Conditions

Studio Bressi

Last updated: October 1, 2025

At Studio Bressi, we believe that a successful creative project is built on trust, clear communication, and mutual respect.

These Terms & Conditions explain how we manage our custom branding, website design, and other creative projects. They are designed to protect both our clients and our studio while ensuring a smooth, organized, and enjoyable experience.

By booking a project with Studio Bressi, you agree to the following conditions.

01. Project Booking & Payments

A deposit is required to reserve your project and secure your place in our studio calendar. Your booking is confirmed once the required deposit has been received and the project agreement has been accepted.

The remaining balance is payable according to the payment schedule outlined in your proposal, invoice, or project agreement.

  • All invoices must be paid by their stated due dates.

  • Work may be paused if a scheduled payment is overdue.

  • Final deliverables, design files, website transfers, and website launches may be withheld until all outstanding project payments have been received.

  • Additional work requested outside the original project scope will be quoted and billed separately.

Deposits compensate the studio for reserved availability and any services performed, as specified in the project agreement. Refund eligibility depends on the work completed, the agreed cancellation terms, and any applicable legal rights.

Full payment is required before final files are released, ownership rights are transferred, or a website is launched or handed over, unless otherwise agreed in writing.

02. Late Payments & Outstanding Balances

Timely payments are essential to keeping projects on schedule.

If an invoice remains unpaid after its due date, Studio Bressi may pause ongoing work and postpone any scheduled delivery or withold deliverables until the outstanding balance has been settled.

Any resulting delay may affect the project's position in our studio calendar.

If payment is not received following written reminders, Studio Bressi may take further steps to recover the outstanding amount in accordance with the applicable law.

This does not grant Studio Bressi an unrestricted right to disable a client-owned website or interfere with independently controlled hosting or accounts.

Studio Bressi is not responsible for delays caused by unpaid invoices. Any limitation of liability for resulting losses applies only to the extent permitted by law.

03. Project Scheduling & Reserved Studio Hours

Every project is carefully scheduled, with dedicated studio hours reserved specifically for your project during an agreed timeframe outlined in the proposal.

This allows us to give each client the attention and creative focus their project deserves while honoring our commitments to other clients.

Your booking reserves a specific period of studio availability, not unlimited access to our time until the project is completed.

The agreed timeline is based on the project scope and the client's timely delivery of materials, feedback, and approvals.

If a project extends beyond its originally scheduled timeframe due to client-related delays, we cannot guarantee the same priority, immediate availability, or original completion date.

Once your reserved project window has passed:

  • Projects currently within their scheduled design windows will take priority.

  • Remaining work will be scheduled around existing studio commitments.

  • Original delivery and launch dates may need to be adjusted.

  • The project may be placed on hold until a new opening becomes available.

  • Additional work, restart services, or rush requests may be subject to separately agreed fees.

A delayed project does not automatically retain its original priority in our studio calendar.

We always aim to be flexible wherever possible, but extending one project must not compromise the time already reserved for others.

04. Client Responsibilities & Content Delivery

Clients are responsible for providing all necessary content, information, and materials by the agreed deadlines.

Depending on the project, this may include:

  • Written website copy and business information.

  • Photography, videos, and other visual assets.

  • Existing logos, brand guidelines, or design files.

  • Login credentials and access to relevant platforms.

  • Feedback, approvals, and requested decisions.

Unless content creation is specifically included in the project scope, all written and visual content must be supplied by the client.

If required materials are missing, incomplete, or delivered late, Studio Bressi may postpone the affected work and adjust the project schedule.

We are not responsible for missed deadlines directly caused by delayed or incomplete client submissions.

Clients must also ensure they have the necessary legal rights and permissions to use all content and assets they provide.

Studio Bressi may rely on the accuracy of client-supplied information and is not responsible for independently verifying every statement, image license, or business detail.

05. Communication & Response Times

Clear and timely communication is an important part of every project.

Clients are expected to respond to requests for feedback, approvals, and project-related information within the timeframes agreed during the project.

If no response or required materials are received for 14 consecutive days, Studio Bressi may place the project on hold after written notice.

When a project is placed on hold:

  • Its reserved studio hours may be released to other clients.

  • The original completion date is no longer guaranteed.

  • Work will resume according to our next available opening.

  • A project restart fee may apply under the conditions described below.

For these terms, business days mean Monday through Friday, excluding public holidays in Slovenia.

06. Project Pauses & Restart Fees

Projects that remain inactive for 14 consecutive days due to missing client communication, feedback, or materials may be placed on hold.

A €300 project restart fee applies when a project is paused due to client inactivity and subsequently restarted.

The restart fee covers the administrative and scheduling work involved in reviewing the project, re-establishing its status, and allocating a new studio window.

The fee does not automatically cover any additional design work or changes to the original project scope.

Restarting a project is subject to Studio Bressi's availability. The next available opening may be several weeks or months later.

If a project remains inactive for an extended period, Studio Bressi may issue a written notice requesting a response by a reasonable deadline. If the client does not respond, the project may be closed or terminated in accordance with the project agreement.

Fees for completed services and other amounts lawfully due remain payable.

07. Project Timelines & Delivery Dates

Project timelines are established based on the agreed scope of work, expected client participation, and available studio hours.

We make every reasonable effort to deliver work within the scheduled timeframe.

However, delivery dates may change due to:

  • Delayed client communication or approvals.

  • Missing or incomplete content.

  • Additional revision requests.

  • Changes to the original scope.

  • Technical issues involving third-party platforms.

  • Circumstances outside our reasonable control.

Any significant changes to the timeline will be communicated as soon as reasonably possible.

Studio Bressi remains responsible for delays caused by the studio in accordance with the project agreement and applicable law.

Delivery dates are estimates unless a specific deadline has been expressly agreed as binding.

08. Revisions & Scope of Work

Every custom project includes a defined scope of work and a specific number of revision rounds, as outlined in the individual proposal or agreement.

Revisions are intended to refine the agreed creative direction rather than introduce an entirely new concept.

The following may be considered additional work:

  • Revision rounds beyond the included allowance.

  • Significant changes to previously approved designs.

  • Requests for additional pages, graphics, or deliverables.

  • New design directions outside the approved concept.

  • Changes to the project scope after work has begun.

  • Additional work required because previously supplied content or instructions have substantially changed.

Any additional work will be quoted and approved before proceeding.

Requests outside the original scope are not included in the agreed project price.

Once a design stage has been approved, returning to that stage for substantial changes may require an additional fee and revised timeline.

09. Feedback & Design Approvals

Clients are responsible for reviewing all presented work carefully and providing clear, consolidated feedback.

Where multiple people are involved in a project, the client should appoint one main contact responsible for collecting feedback and communicating final decisions.

Once a design direction, project stage, or deliverable has been approved, Studio Bressi may proceed to the next stage.

Substantial changes requested after approval may be treated as additional work.

Clients are responsible for checking the accuracy of supplied content, spelling, contact details, pricing, and other business information before final approval.

Final approval does not remove Studio Bressi's responsibility to correct errors or defects for which the studio is legally responsible.

10. Rush Requests & Priority Work

Projects are completed according to our scheduled studio availability.

Rush requests, expedited revisions, or requests to prioritize a delayed project over existing commitments are subject to availability.

Where possible, rush work may be offered for an additional fee, which will be quoted and approved in advance.

Studio Bressi is not obligated to accept rush requests that interfere with previously scheduled projects.

We cannot guarantee expedited completion for projects delayed by late client submissions or approvals.

11. Website Launches & Transfers

Website launches are scheduled once the agreed design work is complete, required materials have been supplied, and final approvals have been received.

Unless otherwise agreed, all outstanding project payments must be settled before the website is launched or transferred to the client.

Studio Bressi may postpone a launch or withold deliverables if:

  • Required content or approvals are missing.

  • Outstanding invoices remain unpaid.

  • Essential third-party services have not been purchased or configured.

  • The client requests changes that affect the agreed launch schedule.

After website handover, the client is responsible for managing their website, subscriptions, domain, and hosting unless an ongoing maintenance agreement is in place.

Studio Bressi does not guarantee specific website traffic, search engine rankings, enquiries, or sales results.

12. Third-Party Platforms & Website Maintenance

Website projects may involve third-party services such as Squarespace, Shopify, domain registrars, payment processors, and external integrations.

Unless expressly included in the project agreement, clients are responsible for:

  • Website platform subscriptions.

  • Domain registration and renewal fees.

  • Hosting and email services.

  • Paid plugins, extensions, or integrations.

  • Third-party font and image licenses.

  • Ongoing website maintenance and content updates.

Studio Bressi is not responsible for outages, pricing changes, discontinued features, or technical limitations introduced by third-party providers outside our control.

Following final website handover, ongoing support, updates, and maintenance are not included unless agreed separately.

Any defects arising from Studio Bressi's own work remain subject to applicable contractual and legal obligations.

13. Project Cancellation & Termination

Clients may request to cancel a project by providing written notice.

Cancellation does not automatically entitle the client to a refund of amounts already paid.

Any refund or outstanding payment will be determined by the services performed, work completed, reserved time where lawfully chargeable, the agreed cancellation terms, and applicable law.

Studio Bressi may also terminate a project where the client materially breaches the agreement, repeatedly fails to meet essential obligations, or engages in abusive or threatening behavior, subject to appropriate notice and any legally required opportunity to remedy the breach.

Upon termination, Studio Bressi will provide an accounting of amounts paid and amounts lawfully due.

Any mandatory consumer cancellation or withdrawal rights remain unaffected.

14. Intellectual Property & Design Ownership

All preliminary concepts, unused designs, drafts, creative explorations, and working files remain the intellectual property of Studio Bressi unless otherwise agreed in writing.

Upon full payment, the client receives the ownership or usage rights to the approved final deliverables as specified in the project agreement.

Unless expressly included, the following are not part of the final deliverables:

  • Unused logo concepts and design directions.

  • Preliminary sketches and creative explorations.

  • Editable working files and internal design documents.

  • Studio templates, processes, and proprietary resources.

  • Third-party licensed materials.

Third-party fonts, photographs, software, and other licensed assets remain subject to their respective license conditions.

Studio Bressi retains the right to display completed projects in its portfolio, website, social media, and promotional materials, subject to any agreed confidentiality restrictions.

15. Final Files & File Storage

Final design files will be delivered digitally once the project has been completed and all required payments have been received.

Studio Bressi retains project files for up to 6 months following project completion.

After this period, files may be permanently deleted without further notice, except when otherwise agreed.

Clients are responsible for downloading, securely storing, and backing up their final files.

Requests for file recovery, re-exporting, or re-delivery after project completion may be subject to an additional fee, quoted in advance.

Studio Bressi cannot guarantee the availability of files after the storage period has ended.

16. Portfolio & Promotional Use

Studio Bressi may photograph, display, and share completed design work for portfolio, marketing, educational, and promotional purposes.

This may include website screenshots, branding presentations, social media content, and project case studies.

Confidential or unreleased work will not be publicly disclosed before an agreed launch or publication date without permission.

Clients who require additional confidentiality should communicate this before the project begins so that appropriate terms can be agreed in writing.

17. Liability & Client Business Results

Studio Bressi provides professional creative services with reasonable care and skill.

While our work is designed to support our clients' businesses, we cannot guarantee specific commercial outcomes, including increased revenue, customer enquiries, conversion rates, or search engine rankings.

Clients remain responsible for their own business operations, legal compliance, privacy policies, website content, and the accuracy of information they supply, except for obligations expressly undertaken by Studio Bressi.

Neither party is responsible for delays caused by events beyond its reasonable control, provided it takes reasonable steps to reduce the impact and informs the other party promptly.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

18. Respectful Collaboration

We believe great creative work comes from positive, professional collaboration.

Both Studio Bressi and the client agree to communicate respectfully and act in good faith throughout the project.

Harassment, abusive communication, threatening behavior, or repeated serious breaches of agreed responsibilities may be grounds for terminating the working relationship in accordance with the project agreement and applicable law.

Our goal is to create a thoughtful and enjoyable experience while respecting everyone's time, work, and commitments.

19. Changes to These Terms

Studio Bressi may update these general terms from time to time.

The version accepted at the time of booking will apply to the project unless both parties agree to changes or an applicable law requires otherwise.

Any changes affecting an active project will be communicated and agreed where required.

20. Governing Law & Individual Agreements

These terms are governed by the laws of the Republic of Slovenia, without prejudice to mandatory consumer protections that may apply under other applicable laws.

Each client's individual project agreement defines the specific services, deliverables, fees, payment schedule, revision allowances, and other project-specific conditions.

Where an individual signed agreement differs from these general terms, the individual agreement takes precedence.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Thank You for Respecting Our Creative Process

Every project at Studio Bressi represents a thoughtful investment of time, expertise, and creativity. These policies allow us to maintain a fair and organized studio schedule, provide each client with the attention they deserve, and deliver work we're genuinely proud of.

Thank you for being part of that process. We can't wait to create something beautiful together.

Your purchase of our templates does not result in the transfer of the intellectual property to you. You must agree to abide by these laws for the continued use of our offerings.

If you violate the company's intellectual property rights, your access to our offerings will be terminated immediately without refund. You may also be subject to further penalties and damages as the law permits.

By accessing or using our offerings, you agree to abide by these terms:

  1. You may not modify, share, or exploit any of our offerings in whole or in part.

  2. You may not use, adapt, or represent our offerings as if they were created by you. (If you are using the template to build a design for a client, you are prohibited from claiming or promoting these designs as solely your own, this can be resolved with a simple footer credit eg.: ‘Web design by Your Business x Studio Bressi’ )

  3. You may not duplicate, trade, or distribute our offerings to another person in any way that earns them money.

  4. You may not create any derivative work and offer competing offerings based on information contained in your purchase.

  5. You may not violate our intellectual property rights, including copyright and trademark, as specified above.

You understand that engaging in unauthorized use of our offerings is considered theft, and we reserve the right to prosecute it as a civil and/or criminal offense.

Template Access

You are granted lifetime access to the templates and supplementary resources, such as tutorials and workbooks. This means you will have access for the entire life of these offerings from the date of purchase, including content updates.

We reserve the right to discontinue our offerings at any time in the future, for any reason. If this happens, we will give you a 30-day notice so you have ample time to back up the resources.

Should we decide to repackage these existing resources into a shorter or longer offering, you agree that we are not obligated to provide you that separate offering for free or at a discount.

We do our best to ensure that your experience of our templates are free of interruptions. However, due to the digital nature of our offerings, we cannot guarantee that your access will not be restricted periodically to make way for repairs, maintenance, or updates.

We will not be held liable for refunds or damages, should our offerings be rendered inaccessible to you due to network failures, server overload, backup procedures, or other similar reasons.

Media Release

By posting, submitting, or distributing content—such as comments, photos, or videos—in our website and community, you are granting us the right to use them in our marketing or promotional efforts, now or at any time in the future, including your template redesign.

This right includes granting us the use of your name and intellectual rights such as copyright and trademark to identify you as the author of your content. You acknowledge that this usage would require neither permission from nor compensation to you.

We are not obligated to display your content on our offerings, and we may choose to remove your content at any time for any reason.

Confidentiality

When you purchase our offerings, we may collect your personal data, including but not limited to the following:

  1. Name, address, and contact details

  2. Demographic information (e.g. age, income, location)

  3. Billing and payment information (e.g. credit or debit card)

  4. Preferences, interests, and other information that may identify you

By participating in the use of our offerings, you grant us the permission to use and store your personal data. The company respects your privacy, so we will not disclose any information you provide except as stated in this agreement.

We will exert our best efforts to keep your data safe and secure. However, we make no assurances about our ability to prevent the loss, misuse, or alteration of your personal data. Submitting your confidential information is done at your own risk.

Lawful Purposes

You agree to access and use our templates and supplementary resources for legitimate and lawful purposes only. This means that you shall not use our offerings in a manner that infringes the rights of others, encourages crime, or constitutes fraud.

Studio BRESSI reserves the right to revoke your access from our offerings if you violate these terms and policies.

We also reserve the right to investigate complaints and reported violations and take any action we deem necessary or appropriate. This includes but is not limited to reporting any suspected unlawful activity to law enforcement and disclosing any information as needed.

POLICIES

The following policies identify the duration and scope of template installation, support, and refund. Note that we cannot help you with issues that arise from third-party plugins and user modifications.

Installation Policy

Your purchase of any template includes the delivery of your template copy to your email within [2 business days] of purchase.

If you avail our installation service on an existing Squarespace site, we will do our best to complete it within [5 business days]. This service includes the following:

  1. Immediate access to the template's video tutorials, code documentation, and other supplementary resources

  2. Transfer of the purchased template as a separate site to your Squarespace account within [2 business days]

  3. Inclusion of placeholder content, images, and graphics as featured in the demo website

  4. Configuration of site styles and plugins to match the template's demo website

These actions fall outside the scope of the template installation:

  1. Migration or transfer of your existing website content and media

  2. User-specific configurations and customization of the template in any form, including changes to content, colors, and functionality

  3. Purchase or setup of a new Squarespace account

  4. Installation of third-party plugins

  5. Revisions of any form

We strive to represent our templates as accurately as possible. But due to Squarespace updates, there may be minor differences between the demo version and the installed template. Some sections or blocks may also appear unstyled before user-specific configurations.

Though installation would not change the content on your existing website, it does materially affect how the content is displayed in the browser. You can set up a cover page or a temporary password during the process.

Since the template will be transferred to your account as a separate site, you will have to manually migrate any preexisting content. Take note that you will also have to replace the placeholder images as well or purchase their respective licenses from our affiliate.

Please understand that backlog or other unforeseen circumstances (e.g. medical emergency, natural disaster, act of war) may cause delays to our services. We will do our best to keep you updated on progress. However, no compensation will be provided for the delayed delivery of the template.

We also do our best to protect your existing website data during the installation. However, in the unlikely event that something goes wrong, [company] cannot be held liable for lost or corrupted blocks, sections, pages, or code. We strongly encourage you to back up your site.

Support Policy

The company offers [30 days] of support beginning on the date of your purchase. Within this period, you are entitled to a reasonable amount of help from us—the definition of which will be determined by Studio BRESSI at our sole discretion.

Requests for support must only be made by submitting a ticket though your template lounge. We aim to respond to your questions [within 48 hours] during weekdays, but please understand that this may take longer for more technical problems or during peak periods.

We provide assistance for the following areas of concern:

  1. Pre-installation of our website templates

  2. Clarification on our template features or settings

  3. Effects of Squarespace updates on our templates

  4. General template bug fixes and patches

However, take note that our support does not cover the following:

  1. General Squarespace questions and issues

  2. Design strategy or guidance on template use

  3. Compatibility with third-party plugins

  4. Issues from modifications of custom code or functionality

  5. Server or hosting configurations

Upon submitting a ticket, be prepared to present your proof of purchase to confirm your order.

We reserve the right to suspend or deny our support services without notice for anyone who disrespects our support team. We will also not tolerate unreasonable demands or abuse of our support system.

Refund Policy

Due to the non-tangible, digital nature of our offerings, we do not issue refunds or exchanges if you are unsatisfied with them. Please review the template page and live demo prior to purchase. Kindly contact us if you have any other questions or clarifications.

Studio BRESSI reserves the right to refuse the delivery of the product for any reason. If payment was made before refusal, the company will promptly issue the refund. You acknowledge that we do not have control over the third-party payment processor and associated fees.

The company also reserves the right to cancel any installation order at any time. If this occurs, you will be refunded the full amount of the service but not the cost of the template itself.
